Article R321-31 of the French Intellectual Property Code

As part of the checks carried out pursuant to 2° of Article L. 327-1, the representative of the supervisory board draws up reports stating the nature, date and location of the observations made. They are signed by their author and the person concerned by the investigations or their legal representative.

If the latter refuses, this is noted in the minutes.

When the person concerned has been heard by a video or audio conference system, the audiovisual or sound recording to which these operations have given rise is the subject of a transcription report submitted for signature to the person concerned. To this end, the transcript, together with the recording, will be sent to the person concerned within thirty days of the date of the videoconference or audioconference.

The transcript will be signed by the person concerned.

Dans le cadre des contrôles effectués en application du 2° de l’article L. 327-1, le représentant du collège de contrôle établit les procès-verbaux énonçant la nature, la date et le lieu des constatations opérées. Ils sont signés par leur auteur et la personne concernée par les investigations ou son représentant légal.

En cas de refus de celle-ci, mention en est faite au procès-verbal.

Lorsque l’intéressé a été entendu par un système de visioconférence ou d’audioconférence, l’enregistrement audiovisuel ou sonore auquel ces opérations ont donné lieu fait l’objet d’un procès-verbal de transcription soumis pour signature à l’intéressé. A cet effet, ce procès-verbal, accompagné de l’enregistrement, lui est adressé dans un délai de trente jours à compter de la date de la visioconférence ou de l’audioconférence.
