Article R3211-5 of the French Public Health Code

The College’s opinion shall mention the names and positions of the members present, the matters dealt with during the meeting and the opinion reached on each of the matters. This opinion, validated by the secretary appointed at the beginning of each meeting, is sent without delay to the director of the establishment who, depending on the case, sends it without delay to the prefect of the department or, in Paris, to the police prefect, or to the judge in charge of liberties and detention.

Any member of the College may request that his or her disagreement with the opinion be recorded.

L’avis du collège mentionne le nom et la qualité des membres présents, les dossiers traités au cours de la séance et l’avis pris pour chacun des dossiers. Cet avis, validé par le secrétaire désigné au début de chaque séance, est transmis sans délai au directeur de l’établissement qui, selon les cas, le transmet sans délai au préfet du département ou, à Paris, au préfet de police, ou au juge des libertés et de la détention.

Tout membre du collège peut demander qu’il soit fait mention de son désaccord avec l’avis rendu.
