Article R3213-10 of the French General Code of Local Authorities

Claims concerning legacies in favour of a department or a departmental public establishment, made by the legal heirs, may be submitted to the Minister of the Interior within six months of the opening of the will. They include the surnames, first names and addresses of the claimants, their order and degree of relationship to the deceased, and the grounds for the claim.

The Minister of the Interior informs the president of the departmental council or the representative of the legatee establishment of these claims and issues the claimants with an acknowledgement of receipt.

Where claims are made after the expiry of the time limit mentioned in the first paragraph or come from persons other than the legal heirs, the acknowledgement of receipt shall state that they are inadmissible.

Les réclamations concernant les legs en faveur d’un département ou d’un établissement public départemental, formulées par les héritiers légaux, sont recevables auprès du ministre de l’intérieur, dans un délai de six mois à compter de l’ouverture du testament. Elles comportent les nom, prénoms et adresse des réclamants, leur ordre et degré de parenté vis-à-vis du défunt, ainsi que les motifs de la réclamation.

Le ministre de l’intérieur informe le président du conseil départemental ou le représentant de l’établissement légataire de ces réclamations et délivre aux réclamants un accusé de réception.

Lorsque les réclamations sont formulées après l’expiration du délai mentionné au premier alinéa ou émanent de personnes autres que les héritiers légaux, l’accusé de réception fait mention de leur irrecevabilité.
