An organisation governed by Title II of Book III may be approved under Article L. 324-8-3 if it:
1° Provides proof that, by virtue of the mandates entrusted to it, it covers a significant number of rightholders for the type of protected works or objects concerned, enabling it to grant authorisation for the modes of exploitation mentioned in II of Article L. 122-5-4, Article L. 137-2-1 or Article L. 139-1;
2° Demonstrates, through the composition of its deliberative and management bodies, the diversity of its members, assessed according to the categories of rightholders to which they belong and the types of work or protected subject matter they represent, their number and the economic importance of the rights managed;
3° Provides evidence, by any means, of the professional qualifications of its managers and corporate officers by reason of:
a) their status as copyright or related rights holders;
> or
b) the nature and level of their qualifications;
> or
c) Or their experience in the management of professional bodies;
4° Indicate the measures it has taken or intends to take to ensure that the rules for distributing the sums collected among right holders are fair and that all right holders are treated equally, whether or not they are members of the organisation, including with regard to licensing conditions;
5° Gives the necessary information on:
a) its administrative organisation and the conditions under which it is set up and equipped;
b) The human and material resources deployed to deal with the effects of extending a contract authorising the exploitation of protected works or objects under the conditions set out in Articles L. 324-8-1 et seq;

c) The means used to collect remuneration and the processing of the data required to distribute this remuneration to the rights holders, whether or not they are members of the organisation;
d) The financing plan and the provisional budget for the three financial years following the application for approval.
