Article R331-3 of the French Code of civil enforcement procedures

The procedure for the distribution of the price of an immovable governed by this Title applies, unless otherwise provided, to the distribution among creditors of the price of an immovable sold without any execution proceedings, after the purging of registrations.
In this case, the procedure is pursued by the most diligent party before the court.
The court appoints a receiver of the funds, unless deposit with the Caisse des dépôts et consignations is ordered. The receiver’s fee is deducted from the funds to be distributed and borne by the creditors in proportion to the sum due to each of them. In the event of a dispute, this fee is set by the court.

Article R331-3

La procédure de distribution du prix de l’immeuble régie par le présent titre s’applique, sauf dispositions contraires, à la répartition entre créanciers du prix d’un immeuble vendu en dehors de toute procédure d’exécution, après purge des inscriptions.
En ce cas, la procédure est poursuivie par la partie la plus diligente devant le tribunal judiciaire.
La juridiction désigne un séquestre des fonds, à moins que la consignation auprès de la Caisse des dépôts et consignations ne soit ordonnée. La rétribution du séquestre est prélevée sur les fonds à répartir et supportée par les créanciers, au prorata de la somme qui revient à chacun d’eux. En cas de contestation, cette rétribution est fixée par le tribunal.
