Where there are several creditors meeting the conditions of article L. 331-1, the pursuing party shall, within two months of publication of the sale document, notify a request for an updated statement of claims to the registered creditors and, if it is aware of them, to the creditors listed inarticle 2377 of the Civil Code.
The updated statement of claims shall be submitted in the form of a lawyer’s opinion within fifteen days of the request being made. If this is not done, the creditor forfeits interest subsequent to the declaration provided for in 4° of article R. 322-7 or article R. 322-13. Where a declaration of claim did not have to be made under these provisions, the request for an updated declaration of claim is equivalent to a summons within the meaning of article L. 331-2.
Notwithstanding the forfeiture that they incur in the distribution procedure pursuant to Article L. 331-2, creditors who have been summoned to declare their claim and who have failed to do so may do so in the manner provided for in the above paragraph in order to have any balance distributed to them.
