Article R3321-2 of the French Public procurement code

For the application of the regulatory provisions of Book I to Saint-Barthélemy:

1° In Article R. 3121-6, the words: “and that a report be sent to the European Commission if it so requests” are deleted;

2° The second paragraph of Article R. 3122-1 is deleted;

3° In article R. 3122-2, the words: “in the Official Journal of the European Union” are replaced by the words “in the Official Journal of the Saint-Barthélemy Local Authority”;

4° Articles R. 3122-4 and R. 3122-5 are deleted;

5° The first paragraph of article R. 3123-18 reads as follows:

“The applicant established in this collectivity shall produce the certificates issued by the competent administrations and bodies locally and the taxes, levies, contributions or social security contributions listed in the order appended to this code shall be replaced, where necessary, by the taxes, levies, contributions or social security contributions for the same purpose applicable locally. ” ;

6° The second paragraph of article R. 3125-6 is deleted;

7° Article R. 3125-7 is worded as follows:

“Art. R. 3125-7 -The award notice is published in the Journal officiel de la collectivité de Saint-Barthélemy”;

8° Article R. 3126-1 2° c is worded as follows:

” c) The operation of passenger transport services, excluding road transport. ” ;

9° In articles R. 3126-4 and R. 3126-5, the words: “in the Official Journal of the European Union” are replaced by the words “in the Official Journal of the collectivity of Saint-Barthélemy”;

10° Article R. 3126-6 is deleted;

10° bis The second paragraph of Article R. 3133-3 is only applicable if the holders of concession contracts choose to send their invoices in electronic form;

11° The second paragraph of Article R. 3135-10 reads as follows:

“This notice is published in the Journal officiel de la collectivité de Saint-Barthélemy. “

Pour l’application des dispositions réglementaires du livre Ier à Saint-Barthélemy :

2° A l’article R. 3122-1, le second alinéa est supprimé ;

3° A l’article R. 3122-2, les mots : ” au Journal officiel de l’Union européenne ” sont remplacés par les mots ” au Journal officiel de la collectivité de Saint-Barthélemy ” ;

4° Les articles R. 3122-4 et R. 3122-5 sont supprimés ;

5° Le premier alinéa de l’article R. 3123-18 est ainsi rédigé :

” Le candidat établi dans cette collectivité produit les certificats délivrés par les administrations et organismes compétents localement et les impôts, taxes, contributions ou contributions sociales figurant dans l’arrêté annexé au présent code sont remplacés, en tant que de besoin, par les impôts, taxes, contributions ou cotisations sociales ayant le même objet applicables localement. ” ;

6° Le second alinéa de l’article R. 3125-6 est supprimé ;

7° L’article R. 3125-7 est ainsi rédigé :

” Art. R. 3125-7.-L’avis d’attribution est publié au Journal officiel de la collectivité de Saint-Barthélemy ” ;

8° Le c du 2° de l’article R. 3126-1 est ainsi rédigé :

” c) L’exploitation de services de transport de voyageurs, à l’exclusion des transports routiers. ” ;

9° Aux articles R. 3126-4 et R. 3126-5, les mots : ” au Journal officiel de l’Union européenne ” sont remplacés par les mots ” au Journal officiel de la collectivité de Saint-Barthélemy ” ;

10° L’article R. 3126-6 est supprimé ;

10° bis Le deuxième alinéa de l’article R. 3133-3 n’est applicable que si les titulaires des contrats de concession choisissent de transmettre leurs factures sous forme électronique ;

11° Le deuxième alinéa de l’article R. 3135-10 est ainsi rédigé :
