Article R3423-12 of the French Labour Code

For application in Saint-Barthélemy and Saint-Martin, article R. 3261-13-1 reads as follows:

“Art. R. 3261-13-1 -The other shared mobility services mentioned in article L. 3261-3-1 include:

1° The self-service hire or provision of mopeds, motorbikes, pedal-assisted cycles and personal mobility devices, with or without a docking station and accessible on the public highway, provided that they are equipped with a non-heating engine or non-heating assistance when motorised;

2° Car-sharing services as defined by the regulations in force locally, provided that the vehicles made available are low-emission vehicles within the meaning of III of article L. 224-7 of the Environment Code or, in Saint-Barthélemy, the regulations applicable locally.

Pour son application à Saint-Barthélemy et à Saint-Martin, l’article R. 3261-13-1 est ainsi rédigé :

“ Art. R. 3261-13-1.-Les autres services de mobilité partagée mentionnés à l’article L. 3261-3-1 comprennent :

1° La location ou la mise à disposition en libre-service de cyclomoteurs, motocyclettes, cycles à pédalage assisté et engins de déplacement personnel, avec ou sans station d’attache et accessibles sur la voie publique, à condition qu’ils soient équipés d’un moteur non thermique ou d’une assistance non thermique lorsqu’ils sont motorisés ;

2° Les services d’autopartage tels que définis par la réglementation en vigueur localement, à condition que les véhicules mis à disposition soient des véhicules à faibles émissions au sens du III de l’article L. 224-7 du code de l’environnement ou, à Saint-Barthélemy, de la règlementation applicable localement.
