Article R40-17 of the French Code of Criminal Procedure

Where it is clear that the person lodging the appeal lodged it after the expiry of the ten-day period provided for in Article 149-3, the chairman of the committee may, after notifying the persons listed at 1° to 3° of Article R. 40-4, decide that there is no need for further investigation or for the acts provided for in Articles R. 40-8 to R. 40-15. He may proceed in the same way when the appeal has been lodged against a decision of the first president of the court of appeal made pursuant to the provisions of articles R. 36 or R. 39.

Article R40-17

Lorsqu’il apparaît manifestement que l’auteur du recours a formé celui-ci après l’expiration du délai de dix jours prévu à l’article 149-3, le président de la commission peut, après en avoir avisé les personnes énumérées aux 1° à 3° de l’article R. 40-4, décider qu’il n’y a pas lieu à plus ample instruction ni à l’accomplissement des actes prévus aux articles R. 40-8 à R. 40-15. Il peut procéder de la même façon lorsque le recours a été formé contre une décision du premier président de la cour d’appel rendue en application des dispositions des articles R. 36 ou R. 39.

Il est alors fait application des dispositions de l’article R. 40-16.
