Article R40-18 of the French Code of Criminal Procedure

On the day of the hearing, after the report, the applicant and the judicial agent of the State or their respective lawyers are heard in their observations, whichever of the persons listed in 1° and 2° of Article R. 40-4 who is the author of the appeal or his lawyer who has the floor first. Where the appeal has been lodged by the public prosecutor at the court of appeal, the applicant or his lawyer has the floor first.

The public prosecutor at the Court of Cassation develops his conclusions.

The applicant and the judicial agent of the State or their respective lawyers may then reply, the applicant or his lawyer having the floor last.

Au jour de l’audience, après le rapport, le demandeur et l’agent judiciaire de l’Etat ou leurs avocats respectifs sont entendus en leurs observations, celle des personnes énumérées aux 1° et 2° de l’article R. 40-4 qui est l’auteur du recours ou son avocat ayant la parole en premier. Lorsque le recours a été formé par le procureur général près la cour d’appel, le demandeur ou son avocat a la parole en premier.

Le procureur général près la Cour de cassation développe ses conclusions.

Le demandeur et l’agent judiciaire de l’Etat ou leurs avocats respectifs peuvent alors répliquer, le demandeur ou son avocat ayant la parole en dernier.
