Article R40-4 of the French Code of Criminal Procedure

The decisions of the first president of the court of appeal may be appealed to the National Commission for Compensation for Detentions by:

1° The applicant;

2° The judicial agent of the State;

3° The public prosecutor at the court of appeal.

Four copies of the statement of appeal shall be submitted to the registry of the court of appeal.

Submission shall be recorded by the registry, which shall mention the date on each copy, one of which shall be returned immediately, and which shall send one copy to the persons listed in 1° to 3° other than the person lodging the appeal.

Les décisions du premier président de la cour d’appel peuvent faire l’objet d’un recours devant la Commission nationale de réparation des détentions de la part :

1° Du demandeur ;

2° De l’agent judiciaire de l’Etat ;

3° Du procureur général près la cour d’appel.

La déclaration de recours est remise au greffe de la cour d’appel en quatre exemplaires.

La remise est constatée par le greffe qui en mentionne la date sur chaque exemplaire, dont l’un est immédiatement restitué, et qui adresse un exemplaire aux personnes énumérées aux 1° à 3° autres que l’auteur du recours.
