Article R40-41 of the French Code of Criminal Procedure

The implementation and updating of the software mentioned in article 230-20 are supervised by a senior prosecuting magistrate, appointed for three years by order of the Minister of Justice, and assisted by a committee of three members appointed under the same conditions.

The authorities managing the processing operations will send it, at its request, any information relating to such processing operations.

This magistrate may order any measures necessary for the exercise of his control.

He shall draw up an annual report which he shall send to the Minister for Justice; he shall send a copy to the authorities managing the software.

La mise en œuvre et la mise à jour des logiciels mentionnés à l’article 230-20 sont contrôlées par un magistrat du parquet hors hiérarchie, nommé pour trois ans par arrêté du garde des sceaux, ministre de la justice, et assisté par un comité composé de trois membres nommés dans les mêmes conditions.

Les autorités gestionnaires des traitements lui adressent, sur sa demande, toutes informations relatives à ces traitements.

Ce magistrat peut ordonner toutes mesures nécessaires à l’exercice de son contrôle.

Il établit un rapport annuel qu’il adresse au garde des sceaux, ministre de la justice ; il en adresse une copie aux autorités gestionnaires des logiciels.
