Article R40-5 of the French Code of Criminal Procedure

Before the national commission, the applicant and the judicial agent of the State may be assisted or represented by a lawyer at the Conseil d’Etat and the Cour de cassation or by a lawyer registered at the bar of a court of appeal or a judicial court.

The provisions of the second paragraph of Article R. 27 are applicable.

Article R40-5

Devant la commission nationale, le demandeur et l’agent judiciaire de l’Etat peuvent être assistés ou représentés par un avocat au Conseil d’Etat et à la Cour de cassation ou par un avocat inscrit au barreau d’une cour d’appel ou d’un tribunal judiciaire.

Les dispositions du second alinéa de l’article R. 27 sont applicables.
