Article R4021-24 of the French Public Health Code

Any body or structure wishing to present continuing professional development initiatives within the framework of the guidelines defined in Article L. 4021-2 shall submit an application for registration to the National Agency for Continuing Professional Development.

The agency will proceed with registration if the body or structure meets the criteria, set by order of the Minister for Health, relating to its ability to propose continuing professional development initiatives and its independence from companies manufacturing or distributing healthcare products.

The Agency may terminate registration if it is established that the organisation or structure no longer meets the criteria mentioned in the previous paragraph. Where it intends to terminate registration, the Agency shall inform the organisation or structure, by any means that provides proof of receipt, and the organisation or structure shall have fifteen days in which to submit its observations.

Tout organisme ou structure qui souhaite présenter des actions de développement professionnel continu s’inscrivant dans le cadre des orientations définies à l’article L. 4021-2 dépose une demande d’enregistrement auprès de l’Agence nationale du développement professionnel continu.

L’agence procède à l’enregistrement si l’organisme ou la structure satisfait à des critères, fixés par arrêté du ministre chargé de la santé, relatifs à sa capacité à proposer des actions de développement professionnel continu et à son indépendance à l’égard des entreprises fabriquant ou distribuant des produits de santé.

L’agence peut mettre fin à l’enregistrement lorsqu’il est constaté que l’organisme ou de la structure ne remplit plus les critères mentionnés à l’alinéa précédent. Lorsqu’elle envisage de mettre fin à l’enregistrement, l’agence en informe, par tout moyen permettant d’apporter la preuve de sa réception, l’organisme ou la structure, qui dispose d’un délai de quinze jours pour faire valoir ses observations.
