Article R41-3-1 of the French Code of Criminal Procedure

Pursuant to article 495-3-1, the chief clerk shall notify the criminal order to the civil party by registered letter with acknowledgement of receipt, which shall specify the time limits and procedures for objecting to the civil provisions of the order set out in article 495-3-1 and article R. 41-8.

This information is also communicated to the civil party when the criminal order is served by the public prosecutor or his delegate.

En application de l’article 495-3-1, le greffier en chef notifie l’ordonnance pénale à la partie civile par lettre recommandée avec demande d’avis de réception qui précise les délais et modalités d’opposition aux dispositions civiles de l’ordonnance fixés à l’article 495-3-1 et à l’article R. 41-8.


Ces informations sont également communiquées à la partie civile lorsque l’ordonnance pénale est notifiée par le procureur de la République ou son délégué.
