Article R4126-10 of the French Public Health Code

The six-month period provided for in article L. 4124-1 runs from the date of receipt by the Disciplinary Chamber of first instance of the complete complaint file.

On expiry of this period, any party may ask the President of the National Disciplinary Chamber to forward the file to another disciplinary chamber. Such a request shall not have the effect of removing the jurisdiction of the Disciplinary Chamber of first instance initially seized.

Where justified by considerations of the proper administration of justice, the President of the National Disciplinary Chamber may assign the case to a chamber that he designates.

The time limits provided for in this article are deducted in accordance with the provisions of articles 640 to 644 of the Code of Civil Procedure.

Le délai de six mois prévu à l’article L. 4124- 1 court à compter de la date de réception par la chambre disciplinaire de première instance du dossier complet de la plainte.

A l’expiration de ce délai, toute partie peut demander au président de la chambre disciplinaire nationale de transmettre le dossier à une autre chambre disciplinaire. Cette demande n’a pas pour effet de dessaisir la chambre disciplinaire de première instance initialement saisie.

Lorsque des considérations de bonne administration de la justice le justifient, le président de la chambre disciplinaire nationale peut attribuer l’affaire à une chambre qu’il désigne.

Les délais prévus au présent article sont décomptés conformément aux dispositions des articles 640 à 644 du code de procédure civile.
