Article R4126-16 of the French Public Health Code

Articles R. 611-2 to R. 611-5 of the Code of Administrative Justice relating to the communication of pleadings and exhibits, the first paragraph of article R. 611-7 relating to the grounds raised ex officio, article R. 611-8-1 relating to the summary pleading and articles R. 613-1, with the exception of its last sentence, to R. 613-4 relating to the closure of the investigation are applicable before the disciplinary chambers of first instance and before the national disciplinary chamber.

The provisions of article R. 611-7 of the Code of Administrative Justice are not applicable when the provisions of article R. 4126-5 of this Code are applied.

Les articles du code de justice administrative R. 611-2 à R. 611-5 relatifs à la communication des mémoires et pièces, le premier alinéa de l’article R. 611-7 relatif aux moyens relevés d’office, l’article R. 611-8-1 relatif au mémoire récapitulatif et les articles R. 613-1, à l’exception de sa dernière phrase, à R. 613-4 relatifs à la clôture de l’instruction sont applicables devant les chambres disciplinaires de première instance et devant la chambre disciplinaire nationale.

Les dispositions de l’article R. 611-7 du code de justice administrative ne sont pas applicables lorsqu’il est fait application des dispositions de l’article R. 4126-5 du présent code.
