Article R4127-328 of the French Public Health Code

Except in emergencies and provided she is not failing in her duty of humanity or her obligation to assist, a midwife has the right to refuse care for professional or personal reasons.

The midwife may withdraw from her duties, provided that she does not thereby harm her patient or the child, that she ensures that the latter will be cared for and that she provides the relevant information to that effect.

Whatever the circumstances, continuity of care must be ensured.

Hors le cas d’urgence et sous réserve de ne pas manquer à ses devoirs d’humanité ou à ses obligations d’assistance, une sage-femme a le droit de refuser des soins pour des raisons professionnelles ou personnelles.

La sage-femme peut se dégager de sa mission, à condition de ne pas nuire de ce fait à sa patiente ou à l’enfant, de s’assurer que ceux-ci seront soignés et de fournir à cet effet les renseignements utiles.

Quelles que soient les circonstances, la continuité des soins doit être assurée.
