Article R4127-353 of the French Public Health Code

Once appointed, the midwife must recuse herself if she considers that the questions put to her do not relate to the practice of midwifery.

In drafting her report, the expert midwife must only reveal information likely to provide an answer to the questions asked in the decision appointing her.

Outside these limits, the expert midwife must not reveal anything she may have learned in the course of her work.

Lorsqu’elle est investie de sa mission, la sage-femme doit se récuser si elle estime que les questions qui lui sont posées sont étrangères à l’exercice de la profession de sage-femme.

Dans la rédaction de son rapport, la sage-femme expert ne doit révéler que les éléments de nature à fournir la réponse aux questions posées dans la décision qui l’a nommée.

Hors de ces limites, la sage-femme expert doit taire ce qu’elle a pu apprendre à l’occasion de sa mission.
