Article R4127-73 of the French Public Health Code

Doctors must protect medical documents concerning people they have treated or examined from any indiscretion, whatever the content or medium of these documents.

The same applies to medical information which may be in his possession.

When using his experience or documents for scientific publication or teaching purposes, the doctor must ensure that it is not possible to identify the persons concerned. Failing this, their agreement must be obtained.

Le médecin doit protéger contre toute indiscrétion les documents médicaux, concernant les personnes qu’il a soignées ou examinées, quels que soient le contenu et le support de ces documents.

Il en va de même des informations médicales dont il peut être le détenteur.

Le médecin doit faire en sorte, lorsqu’il utilise son expérience ou ses documents à des fins de publication scientifique ou d’enseignement, que l’identification des personnes ne soit pas possible. A défaut, leur accord doit être obtenu.
