Article R4212-1 of the French Public Health Code

Except in cases where the offence was committed intentionally and the penalties set out in article L. 541-46 of the Environmental Code are applicable, the offence of failing to collect or failing to collect free of charge unused medicines brought to them by private individuals, including those classified as narcotics, is punishable by a fine of the fourth class.

Hors les cas où, les faits ayant été commis de façon intentionnelle, les peines prévues par l’article L. 541-46 du code de l’environnement sont applicables, est puni de l’amende prévue pour les contraventions de la quatrième classe le fait pour un pharmacien d’officine ou un pharmacien assurant la gérance d’une pharmacie à usage intérieur de ne pas collecter ou de ne pas collecter gratuitement les médicaments non utilisés qui leur sont apportés par les particuliers, y compris ceux classés comme stupéfiants.
