Article R4234-4 of the French Public Health Code

I.- Pursuant to the provisions of article L. 4234-5-1, the chairman of the Disciplinary Board of First Instance may, if he considers that the dispute so warrants, convene the Disciplinary Board in a restricted formation or decide to refer to the full Disciplinary Board a case examined by the restricted formation.

The decisions of the chairman of the Disciplinary Board taken pursuant to this I shall not be subject to appeal and shall not have the force of res judicata.

II.- The restricted formation of the Disciplinary Board of First Instance shall comprise, in addition to its chairman: the chairman of the Disciplinary Board of First Instance; the chairman of the Disciplinary Board of First Instance; the chairman of the Disciplinary Board of First Instance.In addition to its chairman, the Disciplinary Board of First Instance’s restricted panel comprises:

1° For the regional council, four councillors;

2° For section B, four councillors;

3° For section C, four councillors, i.e. two pharmacists in charge or acting in charge and two pharmacists who are delegates, acting delegates or deputies;

4° For section D, four councillors, including at least one assistant pharmacist and one pharmacist representing the other categories listed in section D;

5° For section E, four councillors;

6° For section G, four members, including at least one hospital pharmacist-biologist and one pharmacist working in a private medical biology laboratory;

7° For the council of section H, four councillors, one practising in a public health establishment, another practising in a private health establishment, a third registered on the register of section H and practising in a medico-social establishment or in other hospital structures and a fourth managing the in-house pharmacy of a departmental fire and rescue service or a radiopharmacist.

The restricted formation can only validly deliberate if, in addition to the president, two councillors are present.

III. -In the event of absence, impediment or vacancy, the members are replaced by their substitutes.

Ordinary members are appointed from the Disciplinary Chamber of First Instance.

Article R4234-4

I.-En application des dispositions de l’article L. 4234-5-1, le président de la chambre de discipline de première instance peut, s’il estime que le litige le justifie, réunir la chambre en formation restreinte ou décider de renvoyer à la formation plénière une affaire examinée par la formation restreinte.

Les décisions du président de la chambre de discipline prises en application du présent I ne sont pas susceptibles de recours et ne sont pas revêtues de l’autorité de chose jugée.

II.-La formation restreinte de la chambre de discipline de première instance comprend, outre son président :

1° Pour le conseil régional, quatre conseillers ;

2° Pour la section B, quatre conseillers ;

3° Pour la section C, quatre conseillers, soit deux pharmaciens responsables ou responsables intérimaires et deux pharmaciens délégués, délégués intérimaires ou adjoints ;

4° Pour la section D, quatre conseillers dont au moins un pharmacien adjoint d’officine et un pharmacien représentant les autres catégories inscrites en section D ;

5° Pour la section E, quatre conseillers ;

6° Pour la section G, quatre conseillers dont au moins un pharmacien biologiste praticien hospitalier et un pharmacien exerçant au sein d’un laboratoire de biologie médicale privé ;

7° Pour le conseil de la section H, quatre conseillers, l’un exerçant dans un établissement de santé public, un autre exerçant dans un établissement de santé privé, un troisième inscrit au tableau de la section H et exerçant dans un établissement médico-social ou dans d’autres structures hospitalières et un quatrième gérant la pharmacie à usage intérieur d’un service départemental d’incendie et de secours ou radiopharmacien.

La formation restreinte ne peut valablement délibérer que si, outre le président, deux conseillers sont présents.

III.-En cas d’absence, d’empêchement ou de vacance, les titulaires sont remplacés par leur suppléant.

Les conseillers ordinaux sont désignés au sein de la chambre de discipline de première instance.
