Article R4234-42 of the French Public Health Code

The appeal may be lodged or sent by any means, including by electronic means, that gives a certain date to its receipt at the registry of the National Disciplinary Board.

Upon receipt of the appeal request, the registry shall notify all the addressees of the contested decision that the appeal has been registered and that it has suspensive effect. It shall also notify the Disciplinary Board of First Instance, which shall forward the complete case file to it within eight days, if necessary by digital means.

However, if upon receipt of the appeal, the President of the National Disciplinary Board rules by way of an order, in application of the provisions of article R. 4234-3, the addressees of the contested decision shall be notified of this order without having to be informed of the appeal beforehand.

If the suspensive nature of the appeal has had an effect on the period of execution of the sentence set in the decision of first instance, the President shall, by the same order, set new dates for such execution.

L’appel peut être déposé ou adressé par tout moyen y compris dématérialisé donnant date certaine à sa réception au greffe de la chambre de discipline nationale.

Dès réception de la requête d’appel, le greffe avertit tous les destinataires de la décision attaquée de l’enregistrement de l’appel et de son effet suspensif. Il en avise également la chambre de discipline de première instance qui lui transmet dans les huit jours le dossier complet de l’affaire, au besoin par voie numérique.

Toutefois, si dès réception de l’appel, le président de la chambre de discipline nationale statue par voie d’ordonnance, en application des dispositions de l’article R. 4234-3, les destinataires de la décision attaquée reçoivent notification de cette ordonnance sans avoir à être informés au préalable de l’appel.

Si le caractère suspensif de l’appel a eu un effet sur la période d’exécution de la peine fixée dans la décision de première instance, le président fixe, par la même ordonnance, de nouvelles dates pour cette exécution.
