Article R4234-8 of the French Public Health Code

The competent disciplinary chamber is that of the regional or central council in whose area of jurisdiction the pharmacist or professional company being prosecuted is registered on the roll on the date on which the acts complained of occurred. The same applies if the pharmacist or professional company being prosecuted is not entered on the roll but was at the date of the acts.

When the complaint is directed against a student who is not registered on the roll at the date of referral, the competent disciplinary chamber is that of the council on whose roll the pharmacist with whom the replacement was made is registered.

La chambre de discipline compétente est celle du conseil régional ou central dans le ressort de laquelle le pharmacien ou la société professionnelle poursuivi est inscrit au tableau à la date de survenance des faits reprochés. Il en est de même dans le cas où le pharmacien ou la société professionnelle poursuivi n’est pas inscrit au tableau mais l’était à la date des faits.

Lorsque la plainte est dirigée contre un étudiant non inscrit au tableau à la date de la saisine, la chambre de discipline compétente est celle du conseil au tableau duquel est inscrit le pharmacien auprès duquel a été effectué le remplacement.
