Article R431-22 of the French Code governing the entry and residence of foreign nationals and the right of asylum

As an exception to article R. 431-20, when the application for a residence permit is lodged with the prefecture of the Bouches-du-Rhône department, the prefect of this department is competent to issue a residence permit to foreign nationals, and members of their families, working within the framework of the Agreement on the Establishment of the ITER International Fusion Energy Organization for the Joint Implementation of the ITER Project, signed in Paris on 21 November 2006, or for the Saint-Paul-lez-Durance research centre of the Commissariat à l’énergie atomique et aux énergies alternatives and employed by :
1° A contractor or subcontractor of a contractor of the international organisation mentioned in the first paragraph;
2° The domestic agencies provided for in Article 8 of the agreement mentioned in the first paragraph or a contractor or subcontractor of a contractor of one of these agencies;
3° The commissariat mentioned in the first paragraph or one of its contractors or subcontractors of a contractor.

Article R431-22

Par dérogation à l’article R. 431-20, lorsque la demande de titre de séjour est déposée auprès de la préfecture du département des Bouches-du-Rhône, le préfet de ce département est compétent pour délivrer un titre de séjour aux étrangers, ainsi qu’aux membres de leur famille, travaillant dans le cadre de l’accord sur l’établissement de l’organisation internationale ITER pour l’énergie de fusion en vue de la mise en œuvre conjointe du projet ITER fait à Paris le 21 novembre 2006 ou pour le centre de recherche sis à Saint-Paul-lez-Durance du Commissariat à l’énergie atomique et aux énergies alternatives et employés par :
1° Un contractant ou un sous-traitant d’un contractant de l’organisation internationale mentionnée au premier alinéa ;
2° Les agences domestiques prévues à l’article 8 de l’accord mentionné au premier alinéa ou un contractant ou un sous-traitant d’un contractant de l’une de ces agences ;
3° Le commissariat mentionné au premier alinéa ou l’un de ses contractants ou sous-traitants d’un contractant.
