Article R4311-4 of the French Public Health Code

When the acts performed and the care given within the scope of their own role are provided in a home health, social or medico-social establishment or service, the nurse may, under their responsibility, perform them with the collaboration of care assistants, nursery nurses or educational and social support staff whom they supervise and within the respective limits of the qualifications recognised for each by virtue of their training. This collaboration may form part of the nursing care protocols mentioned in article R. 4311-3.

The nurse may also entrust the nursing auxiliary or childcare auxiliary with the performance, outside of his/her presence if necessary, of routine daily care, defined as care related to a stabilised state of health or a stabilised chronic pathology and which could be performed by the person him/herself if he/she were autonomous or by a carer.

Lorsque les actes accomplis et les soins dispensés relevant de son rôle propre sont dispensés dans un établissement ou un service à domicile à caractère sanitaire, social ou médico-social, l’infirmier ou l’infirmière peut, sous sa responsabilité, les assurer avec la collaboration d’aides-soignants, d’auxiliaires de puériculture ou d’accompagnants éducatifs et sociaux qu’il encadre et dans les limites respectives de la qualification reconnue à chacun du fait de sa formation. Cette collaboration peut s’inscrire dans le cadre des protocoles de soins infirmiers mentionnés à l’article R. 4311-3.

L’infirmier ou l’infirmière peut également confier à l’aide-soignant ou l’auxiliaire de puériculture la réalisation, le cas échéant en dehors de sa présence, de soins courants de la vie quotidienne, définis comme des soins liés à un état de santé stabilisé ou à une pathologie chronique stabilisée et qui pourraient être réalisés par la personne elle-même si elle était autonome ou par un aidant.
