Article R4311-54 of the French Public Health Code

I. – The councils of the Order are elected for a six-year term by direct suffrage in a single-round majority binominal election, half of which is renewed every three years. Each pair is made up of candidates of different genders.

They are elected by the nurses on the roll under the following conditions:

1° The departmental or interdepartmental representatives are elected by the nurses registered on the roll of the Order of the department concerned by the election;

2° Regional or interregional representatives are elected by the full members of the departmental or interdepartmental councils;

3° The national representatives are elected by the full members of the regional or inter-regional councils.

After each renewal, each council elects its chairman and officers from among its members.

II. – However, the election takes place by a single-ballot majority system if the conditions set out in article L. 4312-13 are met. The number of seats allocated to members of the same gender is at least equal to the actual number of members of that gender in the territorial jurisdiction concerned, within the limit of a parity composition of the Board. To this end, two separate ballots are organised for the election of candidates of each sex.

Each elector has one vote for each of these two ballots.

I. – Les conseils de l’ordre sont élus pour six ans au suffrage direct par scrutin binominal majoritaire à un tour et renouvelés par moitié tous les trois ans. Chaque binôme est composé de candidats de sexe différent.

Ils sont élus par les infirmiers inscrits au tableau dans les conditions suivantes :

1° Les représentants départementaux ou interdépartementaux sont élus par les infirmiers inscrits au tableau de l’ordre du département concerné par l’élection ;

2° Les représentants régionaux ou interrégionaux sont élus par les membres titulaires des conseils départementaux ou interdépartementaux ;

3° Les représentants nationaux sont élus par les membres titulaires des conseils régionaux ou interrégionaux.

Après chaque renouvellement, chaque conseil élit en son sein son président et son bureau.

II. – Toutefois, l’élection a lieu au scrutin uninominal majoritaire à un tour dès lors que les conditions prévues à l’article L. 4312-13 sont remplies. La part de sièges dévolus aux membres d’un même sexe est au moins égale à la part effective qu’il représente dans le ressort territorial concerné dans la limite d’une composition paritaire du conseil. A cet effet, deux scrutins distincts sont organisés pour l’élection des candidats de chaque sexe.

Chaque électeur dispose d’une voix, pour chacun de ces deux scrutins.
