Article R4311-90 of the French Public Health Code

The date of the elections to the Disciplinary Chamber of First Instance is announced by the National Council under the same conditions as those laid down in article R. 4311-58.

Candidates shall make their candidacy known under the conditions laid down in Chapter V of Title II of Book I of Part Four of this Code.

In the four months following each renewal of the Regional Council, the latter shall at the same time elect all the full and alternate members of the college referred to in a of 1° and 2° ofarticle R. 4311-89 and renew half of the full and alternate members of the college referred to in b of 1° and 2° of article R. 4311-89. of the Disciplinary Chamber of First Instance.

Voting takes place by secret ballot at the headquarters of the Regional Council. The count is public.

The election is won by a simple majority of the voting members present. Candidates are declared elected under the conditions defined in Chapter V of Title II of Book I of Part Four of this Code.

The minutes are transmitted under the conditions laid down in article R. 4311-61.

La date des élections à la chambre disciplinaire de première instance est annoncée par le conseil national dans les mêmes conditions que celles prévues à l’article R. 4311-58.

Les candidats font connaître leur candidature dans les conditions prévues au chapitre V du titre II du livre Ier de la quatrième partie du présent code.

Dans les quatre mois qui suivent chaque renouvellement du conseil régional, celui-ci procède en même temps à l’élection de l’ensemble des membres titulaires et suppléants du collège mentionné au a des 1° et 2° de l’article R. 4311-89 et au renouvellement par moitié des titulaires et des suppléants du collège mentionné au b des 1° et 2° de l’article R. 4311-89. de la chambre disciplinaire de première instance.

Le vote a lieu à bulletins secrets au siège du conseil régional. Le dépouillement est public.

L’élection est acquise à la majorité simple des membres présents ayant voix délibérative. Les candidats sont proclamés élus dans les conditions définies au chapitre V du titre II du livre Ier de la quatrième partie du présent code.

Le procès-verbal est transmis dans les conditions fixées à l’article R. 4311-61.
