In the event of non-conformity of equipment established by checks carried out by the market surveillance authority, the costs which may be charged to the economic operator in question on the basis of the third paragraph of Article L. 4314-1 include the costs of acquisition, packaging, transport, documentary checks, testing, analysis, physical checks, trials, expert appraisals and storage costs incurred by the authority in establishing this non-conformity.
Where a market surveillance authority intends to ask the economic operator concerned to recover the costs referred to in the previous paragraph, it shall notify it of the amount of recovery envisaged and invite it to submit its observations within a period of one month.
On expiry of this period and in the light of any comments from the interested party, it will notify its decision and issue the corresponding collection order.
