In medical biology laboratories, with a view to carrying out the analytical and post-analytical phases of medical biology examinations and on medical prescription or on the prescription of a nurse practising in advanced practice under the conditions provided for in Article R. 4301-3, venous or capillary blood samples from the ear lobule, fingertips, elbow crease, back of the hand and malleolar region may be taken by:
1° The medical laboratory technicians mentioned in article L. 4352-2, who took up their duties after the date of entry into force of the first order made in application of 2° of the said article ;
2° The medical laboratory technicians mentioned in article L. 4352-2, who took up their duties before the date of entry into force of the order mentioned in 1° and who hold a certificate of competence to take blood samples or a similar certificate issued prior to 9 December 1980;
3° The medical laboratory technicians referred to in article L. 4352-3 who hold a certificate of competence to take blood samples or a similar certificate issued prior to 9 December 1980;
4° Persons performing the duties of medical laboratory technicians mentioned in articles L. 4352-3-1 and L. 4352-3-2, who hold the certificate of competence mentioned in 2° and 3°.
The certificate of competence to take blood samples provided for in this article is awarded after a training period in a department of a public health establishment or a private health establishment of public interest, a centre for information, screening and diagnosis of sexually transmitted infections, a blood transfusion establishment or a medical biology laboratory, and after theoretical and practical tests, under the conditions set by an order of the Minister for Health.
The samples are taken under the responsibility of a medical biologist from the medical biology laboratory.
