Article R4352-13 of the French Public Health Code

In medical biology laboratories, with a view to carrying out the analytical and post-analytical phases of medical biology examinations and on medical prescription or on the prescription of a nurse practising in advanced practice under the conditions provided for in Article R. 4301-3, venous or capillary blood samples from the ear lobule, fingertips, elbow crease, back of the hand and malleolar region may be taken by:

1° The medical laboratory technicians mentioned in article L. 4352-2, who took up their duties after the date of entry into force of the first order made in application of 2° of the said article ;

2° The medical laboratory technicians mentioned in article L. 4352-2, who took up their duties before the date of entry into force of the order mentioned in 1° and who hold a certificate of competence to take blood samples or a similar certificate issued prior to 9 December 1980;

3° The medical laboratory technicians referred to in article L. 4352-3 who hold a certificate of competence to take blood samples or a similar certificate issued prior to 9 December 1980;

4° Persons performing the duties of medical laboratory technicians mentioned in articles L. 4352-3-1 and L. 4352-3-2, who hold the certificate of competence mentioned in 2° and 3°.

The certificate of competence to take blood samples provided for in this article is awarded after a training period in a department of a public health establishment or a private health establishment of public interest, a centre for information, screening and diagnosis of sexually transmitted infections, a blood transfusion establishment or a medical biology laboratory, and after theoretical and practical tests, under the conditions set by an order of the Minister for Health.

The samples are taken under the responsibility of a medical biologist from the medical biology laboratory.

Article R4352-13

Dans les laboratoires de biologie médicale, en vue de la réalisation des phases analytique et postanalytique des examens de biologie médicale et sur prescription médicale ou d’un infirmier exerçant en pratique avancée dans les conditions prévues à l’article R. 4301-3, les prélèvements de sang veineux ou capillaire au lobule de l’oreille, à la pulpe des doigts, au pli du coude, au dos de la main et en région malléolaire peuvent être effectués par :

1° Les techniciens de laboratoire médical mentionnés à l’article L. 4352-2, entrés en fonctions après la date d’entrée en vigueur du premier arrêté pris en application du 2° dudit article ;

2° Les techniciens de laboratoire médical mentionnés à l’article L. 4352-2, entrés en fonctions avant la date d’entrée en vigueur de l’arrêté mentionné au 1° et titulaires du certificat de capacité pour effectuer des prélèvements sanguins ou du certificat analogue délivré antérieurement au 9 décembre 1980 ;

3° Les techniciens de laboratoire médical mentionnés à l’article L. 4352-3 qui sont titulaires du certificat de capacité pour effectuer des prélèvements sanguins ou du certificat analogue délivré antérieurement au 9 décembre 1980 ;

4° Les personnes exerçant les fonctions de techniciens de laboratoire médical mentionnées aux articles L. 4352-3-1 et L. 4352-3-2, titulaires du certificat de capacité mentionné aux 2° et 3°.

Le certificat de capacité pour effectuer des prélèvements sanguins prévu au présent article est délivré après un stage effectué dans un service d’un établissement public de santé ou d’un établissement de santé privé d’intérêt collectif, un centre d’information, de dépistage, de diagnostic des infections sexuellement transmissibles, un établissement de transfusion sanguine ou un laboratoire de biologie médicale, et après des épreuves théoriques et pratiques, dans les conditions fixées par un arrêté du ministre chargé de la santé.

Les prélèvements sont effectués sous la responsabilité d’un biologiste médical du laboratoire de biologie médicale.
