Article R4393-9 of the French Public Health Code

The Prefect of the region designated by order of the Minister for Health, after consulting the Dental Assistants’ Commission, will issue the practice authorisation provided for in article L. 4393-12, on the basis of an application accompanied by a file presented and examined in accordance with the procedures laid down by the order referred to in article R. 4393-16.

The Prefect acknowledges receipt of the application within one month of its receipt and, if necessary, informs the applicant within the same period of any missing documents and information.

If the Regional Prefect does not respond within four months of receipt of the complete application, this will constitute a decision to reject the application.

Article R4393-9

Le préfet de la région désignée par arrêté du ministre chargé de la santé, délivre après avis de la commission des assistants dentaires l’autorisation d’exercice prévue à l’article L. 4393-12, au vu d’une demande accompagnée d’un dossier présenté et instruit selon les modalités fixées par l’arrêté mentionné à l’article R. 4393-16.

Il accuse réception de la demande dans le délai d’un mois à compter de sa réception et le cas échéant, indique au demandeur dans ce même délai les pièces et informations manquantes.

Le silence gardé par le préfet de région à l’expiration d’un délai de quatre mois à compter de la réception du dossier complet vaut décision de rejet de la demande.
