Article R4437-1 of the French Labour Code

In exceptional cases where, due to the nature of the work and in the absence of any technical alternative, the permanent use of individual hearing protectors is likely to result in a greater health or safety risk than not using them, the Labour Inspector may grant exemptions from the provisions of article R. 4432-3 and 1° and 2° of article R. 4434-7.

Article R4437-1

Dans des cas exceptionnels où, en raison de la nature du travail et en l’absence d’alternative technique, l’utilisation permanente des protecteurs auditifs individuels est susceptible d’entraîner un risque plus grand pour la santé ou la sécurité que leur non-utilisation, l’inspecteur du travail peut accorder des dérogations aux dispositions de l’article R. 4432-3 et des 1° et 2° de l’article R. 4434-7.
