Article R4451-94 of the French Labour Code

At the end of the exposure situations provided for in sub-section 1, during the period in which the dose received remains above one of the limit values set in Article R. 4451-6 and by way of derogation from the provisions of this Article, the worker may be assigned to work exposing him to ionising radiation subject to :

1° The issue of a new prior fitness certificate attesting to the absence of any medical contraindication to such work;

2° The prior agreement of the worker concerned who has received, from the occupational physician, information as provided for in 4° of article R. 4624-24;

3° His classification in category A.

The effective dose likely to be received over the next five years, including the dose received as a result of the excess, does not exceed 100 millisieverts.

The employer informs the social and economic committee.

A l’issue des situations d’exposition prévues à la sous-section 1, pendant la période où la dose reçue demeure supérieure à l’une des valeurs limites fixées à l’article R. 4451-6 et par dérogation aux dispositions de cet article, le travailleur peut être affecté à des travaux l’exposant aux rayonnements ionisants sous réserve de :


1° La délivrance d’un nouvel avis d’aptitude préalable attestant l’absence de contre-indication médicale à ces travaux ;


2° L’accord préalable du travailleur concerné qui a reçu, par le médecin du travail, une information telle que prévue au 4° de l’article R. 4624-24 ;


3° Son classement en catégorie A.


La dose efficace susceptible d’être reçue dans les cinq années à venir, incluant la dose reçue dans le cadre du dépassement, n’excède pas 100 millisieverts.


L’employeur en informe le comité social et économique.
