Article R4461-32 of the French Labour Code

I. – The application for authorisation of the training organisations mentioned in 1° of article R. 4461-29 must be sent by registered post with acknowledgement of receipt:

1° To the central services under the authority of the Minister of the Interior for option B “rescue and safety” ;

2° To the services placed under the authority of the director of the department of underwater and sub-aquatic archaeological research as regards option B “underwater and sub-aquatic archaeology”.

II – This file includes information relating to :

1° Identification of the organisation ;

2° The categories of work for which authorisation is requested;

3° The resources deployed;

4° How the training will be financed.

The application is deemed to be complete if the examining department has issued an acknowledgement of receipt or has not informed the applicant, within one month of receipt, by registered letter with acknowledgement of receipt, of the list of missing or incomplete documents.

III. – The competent administrative authority for granting authorisation to a training body is:

1° Where the application for authorisation is submitted by the departments mentioned in 1° of I, the Minister of the Interior;

2° When the application for authorisation is submitted by the departments mentioned in 2° of I, the Director of the Department of Underwater and Subaquatic Archaeological Research.

IV. – The competent administrative authority makes its decision within two months of submission of a complete application. Authorisation is deemed to have been granted at the end of this period. If authorisation is granted, the competent administrative authority will inform the body designated in Article R. 4461-29.

Authorisation is valid for three years. It may be renewed by the competent administrative authority, for an identical period, at the request of the holder of the authorisation sent no later than four months before its expiry date, by registered letter with acknowledgement of receipt. The provisions of II apply to these renewal applications.

Article R4461-32

I. – La demande d’habilitation des organismes de formation, mentionnés au 1° de l’article R. 4461-29, est adressée, par pli recommandé avec demande d’avis de réception :

1° Aux services centraux placés sous l’autorité du ministre de l’intérieur pour ce qui concerne la mention B “secours et sécurité” ;

2° Aux services placés sous l’autorité du directeur du département des recherches archéologiques subaquatiques et sous-marines pour ce qui concerne la mention B “archéologie sous-marine et subaquatique”.

II. ― Ce dossier comprend des informations relatives :

1° A l’identification de l’organisme ;

2° Aux catégories d’intervention pour lesquelles l’habilitation est demandée ;

3° Aux moyens mis en œuvre ;

4° Aux modalités de financement de ces formations.

Le dossier est réputé complet, si le service instructeur a délivré un accusé de réception ou n’a pas fait connaître, dans le délai d’un mois à compter de sa réception, au demandeur, par lettre recommandée avec demande d’avis de réception, la liste des pièces manquantes ou incomplètes.

III. – Pour l’octroi d’une habilitation à un organisme de formation, l’autorité administrative compétente est :

1° Lorsque la demande d’habilitation relève des services mentionnés au 1° du I, le ministre de l’intérieur ;

2° Lorsque la demande d’habilitation relève des services mentionnés au 2° du I, le directeur du département des recherches archéologiques subaquatiques et sous-marines.

IV. – L’autorité administrative compétente se prononce dans un délai de deux mois à compter de la présentation d’une demande complète. L’habilitation est réputée acquise au terme de ce délai. En cas d’octroi de l’habilitation, l’autorité administrative compétente en informe l’organisme désigné à l’article R. 4461-29.

L’habilitation est valable pour une durée de trois ans. Elle peut être renouvelée par l’autorité administrative compétente, pour une durée identique, sur demande du titulaire de l’habilitation adressée au plus tard quatre mois avant sa date d’expiration, par lettre recommandée avec demande d’avis de réception. Les dispositions du II s’appliquent à ces demandes de renouvellement.
