Article R4461-36 of the French Labour Code

To obtain the accreditation provided for in 2° of Article R. 4461-29, the applicant organisation must meet the conditions laid down in the accreditation reference framework defined by the French Accreditation Committee (COFRAC) referred to in Article R. 4724-1.

Joint orders issued by the Minister for Employment and, each insofar as it is concerned, by the ministers concerned, determine the minimum guarantees which the training organisations mentioned in 2° of Article R. 4461-29, in particular with regard to:

1° The qualifications of the persons in charge of training;

2° The teaching methods and skills adapted to the aim pursued;

3° The ability to assess candidates beforehand with regard to their professional skills or their diploma;

4° The ability to comply with the training reference framework comprising the elements listed in I of R. 4461-30;

5° The ability to ensure that knowledge and skills acquired are tested.

Pour obtenir l’accréditation prévue au 2° de l’article R. 4461-29, l’organisme candidat doit remplir les conditions prévues par le référentiel d’accréditation défini par le Comité français d’accréditation (COFRAC) mentionné à l’article R. 4724-1.


Des arrêtés conjoints du ministre chargé du travail et, chacun en ce qui le concerne, des ministres intéressés déterminent les garanties minimales que doivent présenter les organismes de formation mentionnés au 2° de l’article R. 4461-29, notamment en ce qui concerne :


1° La qualification des personnes chargées de la formation ;


2° Les méthodes et capacités pédagogiques adaptées au but poursuivi ;


3° La capacité d’évaluation préalable des candidats au regard de leur compétence professionnelle ou de leur diplôme ;


4° La capacité de se conformer au référentiel de formation comprenant les éléments figurant au I du R. 4461-30 ;


5° La capacité à assurer un contrôle des connaissances et des acquis.
