Article R4511-8 of the French Labour Code

As part of the general coordination of prevention measures, the head of the user company shall alert the head of the external company concerned when he is informed of a serious danger involving one of the workers of that company, even if he considers that the cause of the danger is exclusively due to that company, so that the necessary prevention measures can be taken by the employer concerned.

In addition, it asks the owner of the establishment for the technical files containing the information relating to the search for and identification of asbestos-containing materials provided for in articles R. 1334-29-4 to R. 1334-29-6 of the Public Health Code and article R. 111-45 of the French Construction and Housing Code or, where applicable, the asbestos detection report provided for in article R. 4412-97-5 of this Code. It communicates these documents to the head of the external company working in the establishment.

Au titre de la coordination générale des mesures de prévention, le chef de l’entreprise utilisatrice alerte le chef de l’entreprise extérieure intéressée lorsqu’il est informé d’un danger grave concernant un des travailleurs de cette entreprise, même s’il estime que la cause du danger est exclusivement le fait de cette entreprise, afin que les mesures de prévention nécessaires puissent être prises par l’employeur intéressé.

En outre, il demande au propriétaire de l’établissement les dossiers techniques regroupant les informations relatives à la recherche et à l’identification des matériaux contenant de l’amiante prévus aux articles R. 1334-29-4 à R. 1334-29-6 du code de la santé publique et à l’article R. 111-45 du code de la construction et de l’habitation ou, le cas échéant, le rapport de repérage de l’amiante prévu à l’article R. 4412-97-5 du présent code. Il communique ces documents au chef de l’entreprise extérieure intervenant dans l’établissement.
