Article R4543-21 of the French Labour Code

A lone worker may only carry out operations or work which require him to be on the roof of the passenger compartment of a piece of equipment while it is in motion under the following cumulative conditions:

1° The equipment is fitted with an inspection control device designed and installed in such a way as to guarantee the safety of those involved;

2° The risk of falling is prevented :

a) As a matter of priority, by the design of the installation or by the implementation of collective protection measures;

b) Failing this, by the wearing of personal protective equipment preventing the worker from leaving the surface of the roof of the enclosure, provided that this protection is adapted to the nature of the risk, taking into account the technology of the equipment, the nature and duration of the work and the possibility of carrying it out under ergonomic conditions.

Article R4543-21

Un travailleur isolé ne peut réaliser des interventions ou travaux qui conduisent à sa présence sur le toit de l’habitacle d’un équipement pendant son déplacement qu’aux conditions cumulatives suivantes :

1° L’équipement est doté d’un dispositif de commande de manœuvre d’inspection conçu et installé de manière à garantir la sécurité des intervenants ;

2° La prévention du risque de chute est assurée :

a) Prioritairement, par la conception de l’installation ou par la mise en œuvre de mesures de protection collective ;

b) A défaut, par le port d’un équipement de protection individuelle empêchant toute sortie du travailleur de la surface du toit de l’habitacle, sous réserve que cette protection soit adaptée à la nature du risque compte tenu de la technologie de l’équipement, de la nature et de la durée des interventions ou travaux ainsi que de la possibilité de les réaliser dans des conditions ergonomiques.
