Article R464-13 of the French Commercial code

Within five days of the filing of the declaration, and failing which the declaration shall automatically lapse, the applicant shall send a copy of the declaration, by registered letter with acknowledgement of receipt, to the parties to whom the Competition Authority’s decision has been notified, mentioned in the annex to the letter of notification provided for in the second paragraph of Article R. 464-30, on the one hand, and to the Autorité de la concurrence and the Minister for the Economy, on the other. Within the same time limit and subject to the same penalty, it must provide proof of these notifications to the court registry.

Dans les cinq jours qui suivent le dépôt de la déclaration et à peine de caducité de cette dernière relevée d’office, le demandeur en adresse une copie, par lettre recommandée avec demande d’avis de réception, d’une part, aux parties auxquelles la décision de l’Autorité de la concurrence a été notifiée, mentionnées en annexe de la lettre de notification prévue au deuxième alinéa de l’article R. 464-30, et d’autre part, à l’Autorité de la concurrence et au ministre chargé de l’économie. Dans le même délai et sous la même sanction, il justifie auprès du greffe de ces notifications.
