Article R465-4 of the French Monetary and Financial Code

When a matter is referred to the Public Prosecutor at the Paris Court of Appeal pursuant to Article L. 465-3-6, the Public Prosecutor shall inform the Autorité des marchés financiers and the Public Prosecutor for the Financial State of the time limit set for them to submit their observations.

The decision taken by the Public Prosecutor at the Paris Court of Appeal is notified by registered letter with acknowledgement of receipt or delivered against receipt to the Financial Public Prosecutor and the Autorité des marchés financiers.

The period referred to in IV of Article L. 465-3-6 runs from the date shown on the acknowledgement of receipt of the registered letter or the date shown on the letter of delivery for the purpose of referring the matter to the Public Prosecutor at the Paris Court of Appeal. This period ceases to run on the date shown on the stamp of the post office where the registered letter was sent or on the date shown on the receipt of the letter delivered by the Public Prosecutor to the Financial Public Prosecutor.

Lorsque le procureur général près la cour d’appel de Paris est saisi en application de l’article L. 465-3-6, il informe l’Autorité des marchés financiers et le procureur de la République financier du délai qui leur est imparti pour présenter leurs observations.

La décision prise par le procureur général près la cour d’appel de Paris est notifiée par lettre recommandée avec demande d’avis de réception ou remise contre récépissé au procureur de la République financier et à l’Autorité des marchés financiers.

Le délai mentionné au IV de l’article L. 465-3-6 court à compter de la date figurant sur l’avis de réception de la lettre recommandée ou de la date mentionnée sur la lettre de remise en vue de saisir le procureur général près la cour d’appel de Paris. Ce délai cesse de courir à la date figurant sur le cachet du bureau postal d’émission de la lettre recommandée ou à la date mentionnée sur le récépissé de la lettre remise par le procureur général au procureur de la République financier.
