I.-The first four classes of offences for which prosecution is extinguished by payment of a fixed fine are as follows:
1° Offences punishable under the Highway Code whether or not they result in a withdrawal of points allocated to the driving licence subject to the provisions of article R. 49-8-5 relating to the reduced fixed fine;
2° Offences relating to transport and traffic punishable under the first, third and fourth parts of the Transport Code , with the exception of articles R. 3315-4 and R. 3315-5, and punishable under:
a) Articles R. 211-14 and R. 211-21-5 of the Insurance Code relating to compulsory insurance of land motor vehicles and their trailers and semi-trailers;
b) The first paragraph of article R. 2241-19 of the Transport Code;
c) Article 5 of Decree no. 2008-1455 of 30 December 2008 relating to the declaration and identification of certain motorised vehicles not authorised to circulate on the public highway;
d) Article 9 of Decree no. 2012-280 of 28 February 2012 relating to the “car-sharing” label;
3° Environmental protection offences punishable by:
a) Articles R. 632-1 and R. 634-2 of the Penal Code relating to the abandonment of rubbish, waste, materials and other objects;
b) Articles R. 331-63 to R. 331-66 of the Environment Code relating to the hearts of national parks and articles R332-69 to R332-72 of the same code relating to nature reserves;
c) Article R. 163-2 of the Forestry Code relating to the defence of forests against fire; articles R. 163-4 and R. 163-5 of the same code relating to the taking of forest products without the owner’s authorisation, with the exception of the taking of a volume of between 5 and 10 litres when this is done by a grazing concession holder or his agent on the conceded land; the first paragraph of article R. 163-6 of the same code relating to the movement of vehicles or animals on unauthorised roads; article R. 261-1 of the same code relating to the exercise of regulated activities in disregard of the provisions of the management order provided for in article L. 212-2; article R. 261-5 of the same code relating to the removal of wood by a purchaser outside the authorised periods; articles R. 261-10, R. 261-13, R. 261-14, R. 275-11 and R. 275-12 of the same code relating to the introduction of animals in breach of grazing concessions or the rules for exercising the right of use;
d) Article 10 (second paragraph) of decree no. 2000-1302 of 26 December 2000 relating to environmental protection measures against polluting emissions from compression ignition engines intended to equip non-road mobile machinery;
e) Article L. 322-10-2 of the Environment Code relating to offences recorded by the garderie du domaine du Conservatoire de l’espace littoral et des rivages lacustres and the agents referred to in article L. 332-20 of the same code;
f) The provisions of Chapter VIII and Section 4 of Chapter IX of Title II of Book IV of the Environment Code (regulatory part), relating to hunting rights;
g) Title I of Book II and Title III of Book IV of the Environment Code (regulatory part), relating to water and aquatic environment law and freshwater fishing and fish resource management;
h) Articles R. 541-78 , R. 541-79 and R. 541-83 of the Environment Code relating to waste management.
4° Contraventions punishable by the following provisions of the Rural and Maritime Fishing Code:
a) 3° of II of article R. 201-45 relating to the prevention, surveillance and control of health hazards concerning animals and plants;
b) II of article R. 205-6 relating to the penalty for failure to comply with administrative injunctions;
c) Article R. 215-2, 1° and 5° of article R. 215-5, 1°, 6°, 8° and 9° of I and II of article R. 215-5-1, article R. 215-6, article R. 215-7, 7° and 9° of II and III of article R. 215-8, c and d of 1° of I, a and d of 2° of I and II of article R. 215-10, f, h and j of 1° of I of article R. 215-11, 1° and 3° of I of article R. 215-12, 4° and 5° of I and II of article R. 215-13, 1° to 8° and 10° to 12° of I of article R. 215-14 and 1° to 4° and 7° of article R. 215-15 relating to the keeping and movement of animals and animal products;
d) I, a and c of 2° of II and a of 4° of II of article R. 228-8 and article R. 228-12 relating to measures to prevent, monitor and control animal health hazards;
e) 1° and 3° of article R. 237-3, 2° of article R. 237-5, article R. 237-6 and 2° of article R. 237-7 relating to nutritional quality and food safety;
f) III of article R. 253-54-1 relating to the placing on the market and use of plant protection products;
g) 1° to 3° of II of article R. 254-30, II of article R. 254-30-1 and 2° of article R. 254-30-2 relating to the marketing, sale, free distribution, application and advice on the use of plant protection products;
h) II of article R. 256-32 relating to the mandatory periodic inspection of equipment intended for the application of plant protection products;
i) 3° of article R. 257-3 relating to the control of the primary production of foodstuffs and products intended for animal feed or animal feed of plant origin;
5° Contraventions punishable under the code des postes et des communications électroniques provided for by articles R. 10-2, R. 10-4 and R. 10-9;
6° Contraventions punishable under the code de la santé publique provided for by articles R. 3515-2 to R. 3515-8;
Contraventions relating to the supply of alcoholic beverages provided for and punishable by articles R. 3351-2, R. 3353-5-1 and R. 3353-7 of the Public Health Code;
Contraventions relating to the collection and destruction of unused medicinal products for human use punishable by articles R. 4212-1 and R. 4212-2 of the public health code;
Contraventions relating to the management of perforating infectious risk care activity waste produced by self-treated patients punishable by articles R. 1337-16 and R. 1337-17 of the public health code;
Contraventions relating to the control of plant and animal species harmful to human health, punishable by article R. 1338-10 of the public health code.
Fourth class offences punishable by the first sentence of the third paragraph of article L. 3136-1 of the public health code.
Contraventions relating to health, hygiene and sanitation rules for residential and similar premises and specific provisions of orders issued by the State representative in the department and orders issued by the mayor with the aim of ensuring the protection of public health, provided for and punished by article R. 1312-14 of the public health code.
7° Contraventions punishable under Article R. 622-2 of the Penal Code relating to the divagation of dangerous animals;
8° Contraventions punishable under Articles R. 331-17-2 (3rd paragraph) and R. 331-45 (3rd and 4th paragraphs) and R. 331-45-1 (2nd paragraph) of the Sports Code;
9° Contraventions relating to noise:
a) Offences punishable under Article R. 623-2 of the Penal Code relating to offensive or nocturnal noise or disturbance disturbing the peace of others;
b) Offences punishable under Articles R. 1337-7 and R. 1337-9 of the Public Health Code relating to being at the origin of a particular noise, other than those covered by Article R. 1337-6, of such a nature as to be detrimental to the tranquillity of the neighbourhood or to human health under the conditions laid down in article R. 1334-31, or knowingly facilitating, by aid or assistance, the preparation or consumption thereof.
10° Contraventions relating to weapons punishable by Chapter VII of Title I of Book III of the regulatory part of the Internal Security Code;
11° Contraventions punishable by Articles R. 271-3 to R. 271-6 of the Environmental Code of Saint-Barthélemy;
12° Contraventions relating to explosives precursors punishable by Articles R. 2353-20 and R. 2353-21 of the Defence Code;
13° Offences punishable under Article R. 644-4 of the Criminal Code relating to participation in a demonstration prohibited on the public highway;
14° Offences relating to unmanned aircraft punishable under Articles R. 151-2 to R. 151-3-1 of the Civil Aviation Code;
15° Offences punishable under Article R. 644-3 of the Penal Code relating to the acquisition of manufactured tobacco products sold on the sly;
16° Offences punishable by article R. 20-29-7 of the French Post and Electronic Communications Code;
17° Offences punishable by articles R. 644-2 and R. 644-2-1 of the Penal Code relating to obstructing free movement on the public highway;
18° Offences punishable by articles R. 644-5 and R. 644-5-1 of the Penal Code relating to the violation of certain police measures;
19° Contravention punishable by article R. 644-6 of the Penal Code relating to damaging certain emergency equipment;
20° Contravention punishable by article R. 151-10 of the Civil Aviation Code.
II.-Fifth class contraventions for which public action is extinguished by payment of a fixed fine are as follows:
1° Contraventions punishable by the first and last sentences of the third paragraph of article L. 3136-1 of the Public Health Code.
2° Contravention d’outrage sexiste et sexuel réprimée par l’article R. 625-8-3 du code pénal;
3° Contraventions réprimées par l’article R. 350-31 du code de l’environnement;
4° Contraventions réprimées par l’article R. 163-3 du code forestier relatif à la défense des forêts contre les incendies.
