Article R49-35 of the French Code of Criminal Procedure

The request for transmission drawn up, pursuant to Article 695-9-33, by the departments or units mentioned in Article 695-9-31, shall contain the information listed in the model in Annex B to Framework Decision 2006/960/JHA of 18 December 2006 and specifying, in particular:

1° The expected time limit for transmitting the information and, where appropriate, the reasons for the urgent processing requested;

2° The circumstances in which the offence was committed;

3° The nature of the offence;

4° The purposes for which the information is requested;

5° The link between those purposes and the person to whom the information relates;

6° The identity of the person or persons who are the subject of the investigations justifying the request for information;

7° The reasons suggesting that the information is held by the services of the requested State;

8° The restrictions on the use of the information.

La demande de transmission établie, en application de l’article 695-9-33, par les services ou unités mentionnés à l’article 695-9-31, comporte les informations énumérées dans le modèle figurant à l’annexe B de la décision-cadre 2006/960/JAI du 18 décembre 2006 et précisant, notamment :

1° Le délai attendu pour la transmission des informations et, le cas échéant, les motifs du traitement d’urgence demandé ;

2° Les circonstances de la commission de l’infraction ;

3° La nature de l’infraction ;

4° Les fins auxquelles les informations sont demandées ;

5° Le lien entre ces fins et la personne à laquelle ces informations se rapportent ;

6° L’identité de la personne ou des personnes faisant l’objet des investigations justifiant la demande d’informations ;

7° Les raisons laissant supposer que les informations sont détenues par les services de l’Etat requis ;

8° Les restrictions concernant l’utilisation des informations.
