Article R50-46 of the French Code of Criminal Procedure

Failing submission of the supporting documents and declarations within the time limits and conditions defined in Article R. 50-45, the department managing the file shall send the Ministry of the Interior the notice provided for in articles 706-25-10 and R. 50-54.

Following registration of the declaration of any cross-border movement, the department managing the file sends the Ministry of the Interior the notice provided for in articles 706-25-10 and R. 50-54.

The public prosecutor competent to prosecute breaches of the obligations of article 706-25-7 is the one competent pursuant to articles 706-17 et seq.

A défaut de présentation des justificatifs et déclarations dans les délais et conditions définis à l’article R. 50-45, le service gestionnaire du fichier adresse au ministère de l’intérieur l’avis prévu par les articles 706-25-10 et R. 50-54.

A la suite de l’enregistrement de la déclaration de tout déplacement transfrontalier, le service gestionnaire du fichier adresse au ministère de l’intérieur l’avis prévu par les articles 706-25-10 et R. 50-54.

Le procureur de la République compétent pour la poursuite des violations des obligations de l’article 706-25-7 est celui compétent en application des articles 706-17 et suivants.
