Article R50-74 of the French Code of Criminal Procedure

On the decision of its chairman, who is responsible for its implementation, the multidisciplinary commission on security measures may carry out or have carried out throughout France any examinations, hearings, administrative enquiries, expert reports or other useful measures.

The commission may request the appearance of the convicted person before giving its opinion. This appearance is automatic if the convicted person so requests. They may be assisted by their lawyer.

To this end, the commission may also use audiovisual telecommunication means in accordance with the provisions of Article 706-71.

This committee may consult the information contained in the convicted person’s individual file referred to in article L. 214-1 du code pénitentiaire.

Sur décision de son président, qui en assure la mise en œuvre, la commission pluridisciplinaire des mesures de sûreté peut procéder ou faire procéder sur l’ensemble du territoire national à tous examens, auditions, enquêtes administratives, expertises ou autres mesures utiles.

La commission peut demander la comparution de la personne condamnée avant de donner son avis. Cette comparution est de droit si la personne condamnée en fait la demande. Elle peut être assistée de son avocat.

A cette fin, la commission peut également utiliser les moyens de télécommunication audiovisuelle conformément aux dispositions de l’article 706-71.

Cette commission peut consulter les éléments figurant dans le dossier individuel du condamné mentionné à l’article L. 214-1 du code pénitentiaire.
