Article R50 quinquies of the French Code of Criminal Procedure

Subject to the rules relating to the secondment and secondment of civil servants, the specialised assistant comes under the authority of the heads of the court of appeal referred to in the first paragraph of the preceding article.

He is placed by them, where appropriate, for a period that they determine, with the heads of one or more judicial courts referred to in articles 52-1,704,705or 705-1, which set out the conditions under which he may perform his duties.

In the performance of these duties, the specialised assistant may neither receive nor seek instructions other than those from the magistrate or magistrates under whose direction he or she is placed.

Article R50 quinquies

Sous réserve des règles relatives à la mise à disposition et au détachement des fonctionnaires, l’assistant spécialisé relève de l’autorité des chefs de la cour d’appel visée à l’alinéa premier de l’article précédent.

Il est placé par ceux-ci, le cas échéant, pour une période qu’ils déterminent, auprès des chefs d’un ou de plusieurs tribunaux judiciaires visés aux articles 52-1,704,705 ou 705-1, qui fixent les conditions d’exercice de ses fonctions.

Dans l’exercice desdites fonctions, l’assistant spécialisé ne peut recevoir ni solliciter d’autres instructions que celles du ou des magistrats sous la direction desquels il est placé.
