When a financial institution has provided evidence to the Autorité de contrôle prudentiel et de résolution that it meets the conditions set out in the second paragraph of Article L. 511-28, the Autorité shall issue it with a certificate. The Authority shall also send a certificate to the competent authorities of the host Member State, at the same time as the notification referred to in the first paragraph of Article L. 511-28, or the declaration referred to in the fourth paragraph of the same Article.
When the Autorité de contrôle prudentiel et de résolution receives the notification provided for in the first paragraph of Article L. 511-28 from a financial institution and decides not to transmit this notification to the competent authority of the host Member State, it shall inform the institution of the reasons for its decision within three months of receiving the notification in due form.
In the event of a change in the situation of a financial institution which affects the conditions mentioned in the second paragraph of Article L. 511-28, the institution shall inform the Autorité de contrôle prudentiel et de résolution without delay. If the Autorité considers that the institution is no longer eligible for the arrangements provided for in the first paragraph and the fourth paragraph of Article L. 511-28, it shall immediately inform the competent authorities of the host Member States concerned.
