Article R5121-209 of the French Public Health Code

For the purposes of this section, advanced therapy medicinal products prepared on an ad hoc basis mean the advanced therapy medicinal products mentioned in 17° of Article L. 5121-1.

For the purposes of II of Article L. 4211-9-1, only advanced therapy medicinal products prepared on an ad hoc basis which are autologous, i.e. which come from the person him/herself, including when they meet the definition of combined advanced therapy medicinal products, and which are not subject to substantial manipulation within the meaning of Annex I to Regulation (EC) No 1394/2007 of the European Parliament and of the Council of 13 November 2007 on advanced therapy medicinal products and amending Directive 2001/83/EC and Regulation (EC) No 726/2004, may be prepared and distributed as part of the same medical procedure as the removal of the autologous tissues or cells used in their composition.

Pour l’application de la présente section, on entend par médicaments de thérapie innovante préparés ponctuellement les médicaments de thérapie innovante mentionnés au 17° de l’article L. 5121-1.

Pour l’application du II de l’article L. 4211-9-1, seuls les médicaments de thérapie innovante préparés ponctuellement autologues, c’est à dire provenant de la personne elle-même, y compris lorsqu’ils répondent à la définition des médicaments de thérapie innovante combinés, et ne faisant pas l’objet d’une manipulation substantielle au sens de l’annexe I du règlement (CE) n° 1394/2007 du Parlement européen et du Conseil du 13 novembre 2007 concernant les médicaments de thérapie innovante et modifiant la directive 2001/83/ CE ainsi que le règlement (CE) n° 726/2004, peuvent être préparés et distribués dans le cadre de la même intervention médicale que celle du prélèvement des tissus ou des cellules autologues entrant dans leur composition.
