Article R5122-12 of the French Public Health Code

Pursuant to Article L. 5122-1, an application for an advertising approval for a medicinal product, as provided for in Article L. 5122-9, is made for any form of information, as defined by Article L. 5122-1, communicated to healthcare professionals authorised to prescribe, dispense or use this medicinal product in the exercise of their profession, in particular on the occasion of:

1° The presentation of the medicinal product to these professionals by the persons mentioned in article L. 5122-11;

2° Studies or surveys of these professionals;

3° Scientific meetings or congresses attended by these professionals, in particular when these meetings or congresses are sponsored by a contribution to the financing of these meetings or congresses;

4° Television programmes aimed at these professionals, in particular when these programmes are sponsored under the conditions and within the limits set by regulations relating to audiovisual communication.

En application de l’article L. 5122-1, la demande de visa de publicité pour un médicament, prévu à l’article L. 5122-9, est formée pour toute forme d’information, telle que définie par l’article L. 5122-1, communiquée aux professionnels de santé habilités à prescrire, dispenser ou utiliser dans l’exercice de leur art ce médicament, notamment à l’occasion :

1° De la présentation du médicament à ces professionnels par les personnes mentionnées à l’article L. 5122-11 ;

2° Des études ou enquêtes auprès de ces professionnels ;

3° Des réunions ou congrès scientifiques auxquels assistent ces professionnels, en particulier lorsque ces réunions ou congrès font l’objet d’un parrainage consistant en une contribution au financement de ces réunions ou congrès ;

4° Des émissions de télévision destinées à ces professionnels, en particulier lorsque ces émissions font l’objet d’un parrainage dans les conditions et limites fixées par la réglementation relative à la communication audiovisuelle.
