Article R5123-2-1 of the French Public Health Code

In the case of chronic treatment, when the period of validity of a renewable prescription has expired, the pharmacist will dispense the medicinal products required to continue the treatment if the following conditions are met:

1° The prescription includes a prescription for the medicinal product allowing, in accordance with the provisions of article R. 5123-2, a total duration of treatment of at least three months;

2° This medicinal product does not fall into one of the categories mentioned in the ministerial order provided for in article L. 5125-23-1.

The pharmacist will dispense the marketed pack containing the smallest number of dosage units. He shall mark the prescription with the words “dispensing by the exceptional procedure of an additional box”, indicating the speciality or specialities dispensed. He will also stamp the prescription with the pharmacy stamp and the date of issue.

He informs the prescribing doctor of the dispensation as soon as possible and by any means at his disposal.

The same prescription may only be dispensed once in application of this article.

Article R5123-2-1

Dans le cadre d’un traitement chronique, lorsque la durée de validité d’une ordonnance renouvelable est expirée, le pharmacien dispense les médicaments nécessaires à la poursuite du traitement si les conditions suivantes sont remplies :

1° L’ordonnance comporte la prescription du médicament permettant, en application des dispositions de l’article R. 5123-2, une durée totale de traitement d’au moins trois mois ;

2° Ce médicament ne relève pas d’une des catégories mentionnées dans l’arrêté ministériel prévu à l’article L. 5125-23-1.

Le pharmacien délivre le conditionnement commercialisé comportant le plus petit nombre d’unités de prise. Il porte sur l’ordonnance la mention ” délivrance par la procédure exceptionnelle d’une boîte supplémentaire ” en indiquant la ou les spécialités ayant fait l’objet de la dispensation. Il appose en outre sur l’ordonnance le timbre de l’officine et la date de délivrance.

Il informe de la dispensation le médecin prescripteur dès que possible et par tous moyens dont il dispose.

La même ordonnance ne peut donner lieu qu’à une seule dispensation en application du présent article.
