Article R5124-37 of the French Public Health Code

If the duties of a pharmacist in charge are terminated or not renewed, the person concerned may refer the matter to the central council of the relevant section of the Ordre national des pharmaciens.

After hearing both parties, the Council will issue an opinion as to whether or not the person concerned has failed to fulfil the obligations incumbent upon him, in the interests of public health, in his capacity as responsible pharmacist.

This article does not apply to pharmacists covered by the provisions of article L. 4138-2 of the Defence Code.

Dans le cas où il est mis fin aux fonctions d’un pharmacien responsable ou que celles-ci, venues à leur terme, ne sont pas renouvelées, l’intéressé peut saisir le conseil central de la section compétente de l’ordre national des pharmaciens.

Le conseil, après instruction contradictoire, émet un avis portant sur le point de savoir si l’intéressé a manqué ou non aux obligations qui lui incombaient, dans l’intérêt de la santé publique, en sa qualité de pharmacien responsable.

Le présent article ne s’applique pas aux pharmaciens relevant des dispositions de l’article L. 4138-2 du code de la défense.
