Article R5124-58 of the French Public Health Code

The pharmaceutical establishment of a company or organisation mentioned in Article R. 5124-2 engaged in wholesale, free transfer or wholesale distribution must keep, for each incoming and outgoing transaction, including when it uses a broker, at least the following information:

1° the date of the transaction

2° The name of the medicinal product or other pharmaceutical product;

3° The number and expiry date of the various batches with the quantities supplied and received per batch, in accordance with the good practices referred to in article L. 5121-5 ;

4° The name and address of the supplier and recipient.

For a delivery to a legal or natural person authorised to dispense medicinal products or other pharmaceutical products, this information is given on a document which is attached to the delivery. For a medicinal product, this document also includes the pharmaceutical form of the medicinal product.

This information is kept in the form of invoices, on a computer medium or in another appropriate form.

The supplier and the recipient shall keep this information for five years at the disposal of the competent inspectorate.

For blood-derived medicinal products, a pharmaceutical establishment must also comply with the provisions of articles R. 5121-185 and R. 5121-195.

Article R5124-58

L’établissement pharmaceutique d’une entreprise ou d’un organisme mentionné à l’article R. 5124-2 se livrant à la vente en gros, à la cession à titre gratuit ou à la distribution en gros conserve, pour chaque transaction d’entrée et de sortie, y compris lorsqu’il a recours à un courtier, au moins les informations suivantes :

1° La date de la transaction ;

2° le nom du médicament ou autre produit pharmaceutique ;

3° Le numéro et la date de péremption des différents lots avec les quantités fournies et reçues par lot, conformément aux bonnes pratiques mentionnées à l’article L. 5121-5 ;

4° Les nom et adresse du fournisseur et du destinataire.

Pour une livraison à une personne morale ou physique habilitée à dispenser des médicaments ou autres produits pharmaceutiques, ces informations sont portées sur un document qui est joint à la livraison. Pour un médicament, ce document comporte en outre la forme pharmaceutique du médicament.

Ces informations sont conservées sous la forme de factures, sur un support informatique ou sous une autre forme appropriée.

Le fournisseur et le destinataire tiennent ces informations pendant cinq ans à la disposition de l’inspection compétente.

Pour les médicaments dérivés du sang, un établissement pharmaceutique se conforme en outre aux dispositions des articles R. 5121-185 et R. 5121-195.
